Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of BreakerHQ, including our website, software, artificial intelligence features, mobile experiences, integrations, APIs, and related services.

By creating an account, purchasing a subscription, uploading content, connecting third-party platforms, or otherwise using BreakerHQ, you agree to be bound by these Terms.

If you do not agree with these Terms, you may not access or use the BreakerHQ platform.

Eligibility

You must be at least eighteen (18) years old, or the age of legal majority in your jurisdiction, to create an account or use BreakerHQ.

By using the platform you represent that you have the legal authority to enter into these Terms and that all information you provide is accurate and current.

The BreakerHQ Service

BreakerHQ is an AI-powered platform built for livestream breakers and content creators. Our software helps users upload, analyze, organize, manage, and publish short-form content using artificial intelligence.

Current and future services may include AI clip generation, AI coaching, content libraries, social media publishing, analytics, business intelligence, community features, reputation systems, and other creator-focused tools.

BreakerHQ continually evolves. Features may be added, modified, suspended, or removed as the platform grows.

Accounts

You are responsible for maintaining the security of your account and all activity occurring through your account.

• Keep your password secure.
• Do not share your account credentials.
• Provide accurate account information.
• Notify BreakerHQ if you believe your account has been compromised.

BreakerHQ is not responsible for unauthorized access resulting from your failure to protect your account credentials.

Subscriptions & Billing

Certain features require an active paid subscription.

Subscription pricing is displayed before purchase and is processed securely through Stripe.

Unless otherwise stated, subscriptions automatically renew until cancelled. You may cancel future renewals at any time through your billing portal.

Except where required by law, subscription fees are non-refundable for completed billing periods.

Your Content

You retain ownership of all videos and other content you upload to BreakerHQ.

By uploading content you grant BreakerHQ a limited license to store, process, analyze, generate clips, create AI outputs, and otherwise provide the services you request.

This license exists solely for operating BreakerHQ and does not transfer ownership of your content to us.

AI Generated Content

BreakerHQ uses artificial intelligence to generate clips, captions, titles, recommendations, coaching, thumbnails, analytics, and other creator tools.

Artificial intelligence is inherently imperfect. AI-generated content may contain errors, omissions, or inaccurate recommendations.

You are solely responsible for reviewing all AI-generated content before publishing it.

BreakerHQ does not guarantee views, virality, revenue, customer growth, engagement, or business success.

Acceptable Use

BreakerHQ is intended to help creators manage and grow their content. You agree to use the platform responsibly and in compliance with all applicable laws.

You may not:

• Upload content you do not own or have permission to use.
• Violate copyrights, trademarks, privacy rights, or other intellectual property rights.
• Attempt to reverse engineer, copy, or exploit the BreakerHQ platform.
• Interfere with the operation or security of the service.
• Use bots or automated systems outside approved BreakerHQ functionality.
• Upload malware, viruses, or harmful software.
• Attempt unauthorized access to other accounts or systems.
• Use BreakerHQ for illegal, fraudulent, abusive, or deceptive purposes.

Third-Party Services

BreakerHQ integrates with trusted third-party providers to deliver certain features of the platform.

These providers may include OpenAI, Stripe, TikTok, Supabase, Vercel, Railway, and other infrastructure or cloud providers.

Your use of third-party services remains subject to their respective terms, privacy policies, availability, and operational decisions. BreakerHQ is not responsible for outages, API changes, policy changes, account actions, or service interruptions caused by third-party providers.

Intellectual Property

BreakerHQ and its licensors retain all ownership rights in the BreakerHQ software, branding, artificial intelligence systems, algorithms, source code, designs, logos, documentation, and platform features.

Except as expressly permitted by these Terms, no part of BreakerHQ may be copied, modified, distributed, sold, reverse engineered, or otherwise exploited without prior written permission.

Beta & Future Features

BreakerHQ may release experimental, beta, preview, or early-access features from time to time.

These features may change, be modified, produce unexpected results, or be discontinued without prior notice.

By using beta features, you acknowledge that they may not perform as intended and are provided without additional warranties.

Disclaimer of Warranties

BreakerHQ is provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by applicable law, BreakerHQ disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee uninterrupted service, error-free operation, or that AI-generated outputs will always be accurate, complete, or suitable for every situation.

Limitation of Liability

To the fullest extent permitted by law, BreakerHQ shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the platform.

This includes, without limitation, loss of revenue, business, profits, followers, data, uploaded content, AI-generated errors, third-party service interruptions, or social media platform actions.

In jurisdictions where limitations of liability are permitted, BreakerHQ's maximum aggregate liability shall not exceed the amount paid by you to BreakerHQ during the twelve (12) months immediately preceding the event giving rise to the claim.

Termination

BreakerHQ may suspend or terminate accounts that violate these Terms, abuse the platform, engage in fraudulent activity, infringe intellectual property rights, or otherwise threaten the security or integrity of the service.

We reserve the right to investigate suspected violations and take appropriate action, including suspension or permanent termination.

Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

Changes to These Terms

BreakerHQ may update these Terms periodically as the platform evolves.

Material changes will be reflected by updating the "Last Updated" date at the top of this page. Continued use of BreakerHQ after changes become effective constitutes acceptance of the revised Terms.

Content Ownership & Responsibility

You retain ownership of all videos, livestreams, clips, and other content you upload to BreakerHQ.

You are solely responsible for ensuring that you own or otherwise have permission to upload, process, publish, and distribute your content. BreakerHQ does not verify ownership of uploaded materials.

By using BreakerHQ, you grant us a limited license to store, process, analyze, generate AI-powered outputs, and otherwise provide the services you request. This license does not transfer ownership of your content to BreakerHQ.

Copyright Policy

BreakerHQ respects intellectual property rights. If you believe content available through BreakerHQ infringes your copyright or other intellectual property rights, please contact us with sufficient information for us to investigate the claim.

We reserve the right to remove allegedly infringing content and suspend or terminate accounts that repeatedly violate intellectual property rights.

Entire Agreement

These Terms, together with our Privacy Policy and any additional policies referenced within the BreakerHQ platform, constitute the entire agreement between you and BreakerHQ regarding your use of the service.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
